Welcome to Tricia – Journaling Your Life! These Terms of Service (“Terms”) govern your use of Tricia, a free social journaling app where you can write personal journals, interact with AI-generated agents, and share AI-generated content in group communities. By using Tricia, you agree to these Terms. If you do not agree, please do not use the app. We’ve written these Terms in clear language to help you understand your rights and obligations.

1. User Content Policy

a. Ownership of Content: You retain ownership of any content you create, input, or post on Tricia (including text, images, and AI-generated journal entries). Tricia does not claim ownership of your personal posts. However, by posting content on Tricia, you give us permission to use it. Specifically, you grant Tricia a non-exclusive, worldwide, royalty-free license to host, use, copy, modify (for technical purposes, like resizing images), publicly display, and distribute your content within the app. This license is only for the purpose of operating, promoting, and improving the Service, and to display your content to you and other users as you direct. For example, if you post in a group, you allow us to show that post to other group members. This license ends when you delete your content from our systems.

b. Community Guidelines: When you create or share content on Tricia (even if it’s AI-generated), you must follow our community guidelines and all applicable laws. You are responsible for the content you post. This means you should not post anything that:

Violates laws or rights: Don’t share content that is illegal, infringes anyone’s intellectual property or privacy rights, or breaches any contract or legal duty.

Is harmful or objectionable: No content that is hateful, harassing, bullying, threatening, or encourages violence or self-harm. Avoid obscene, pornographic, or sexually exploitative material.

Is false or misleading: Do not knowingly spread misinformation or impersonate others.

Is spam or advertising: Don’t use Tricia to advertise or solicit others without permission (aside from approved app features like designated promotion posts).

These are just examples — please use common sense and be respectful. We may publish detailed Community Guidelines separately, and those also apply to you.

c. Moderation and Removal: Tricia reserves the right to moderate and manage user content to keep our community safe. We may, at our discretion and without notice, remove, edit, or restrict access to any content that we believe violates these Terms, our policies, or any law. We may also suspend or terminate accounts that engage in serious or repeated violations. We are not responsible for any loss of data if we remove content that violates our rules. Remember: even if content is AI-generated, if you publish it, it must comply with our guidelines.

d. Feedback: If you provide us with feedback or suggestions on how to improve Tricia, we may use it without obligation to you. Providing feedback is optional, but if you do, you allow us to use it freely to improve our app.


2. Privacy and Data Collection

Your privacy is important to us. Our Privacy Policy (available on our website and in the app) explains what data we collect and how we use and protect it. By using Tricia, you agree to the data practices described in our Privacy Policy. In general, here’s what you should know:

Data We Collect: Tricia collects information needed to run the app and provide features. This includes the content you input or publish (like your journal entries and group posts), your chat logs and interactions with AI agents, and basic account info. We may also collect usage data (e.g., app usage statistics, device information) to help improve the service.

How We Use Data: We use your data to operate Tricia’s features (for example, to display your posts to you and others, or to have the AI agents remember your past chats), to personalize your experience, and to improve our AI and services. In addition, published group content may be visible to other users in those groups. We do not sell your personal chat logs or journal entries to third parties; any use of your data with third-party services (like analytics or ads) is described in the Privacy Policy.

Protection of Data: We take reasonable measures to protect your information. However, no online service is 100% secure, so we cannot guarantee absolute security. Please keep your account credentials safe.

Privacy Choices: You can manage certain privacy settings in the app (for example, what information you share in your profile). For full details on data collection, use, sharing, and your rights, please review the Privacy Policy. If you have questions about our data practices, contact us at the support email listed at the end of these Terms.

3. Advertising and Promotions

Tricia is a free service and may include advertisements and sponsored content to support our operations. By using the app, you understand and agree that:

In-App Advertising: You may see ads, promotions, or sponsored posts while using Tricia. For example, we might display promotions for third-party services, including clinic promotions or wellness services that align with the journaling experience. We strive to ensure ads are not intrusive and are relevant, but the content of ads is provided by external advertisers.

No Endorsement: Showing an ad or promotion in Tricia does not mean we endorse or recommend the advertised product, service, or clinic. We do not verify the claims made in advertisements. Any information or content in ads is the responsibility of the advertiser.

Advertising Policies: We require advertisers to follow our ad content guidelines so that ads are appropriate. For instance, ads must not violate laws or be overly inappropriate for our audience. If you spot an ad that you believe violates our policies or is offensive, you can report it to us. We reserve the right to remove or reject any advertisement in the app at our discretion.

User Interactions with Ads: Any interaction or transaction you have with advertisers or third-party sponsors is solely between you and that third party. This includes, for example, clicking an ad to sign up for a clinic’s program or purchasing a product you saw advertised. Tricia is not responsible for anything that happens outside of our app, even if you learned about it through Tricia. If you choose to visit a third-party website or app or give them your information, do so with caution and review their terms and privacy policies.

Personalized Ads: We may use your data (as described in the Privacy Policy) to show you more relevant ads. For example, if you often journal about fitness, you might see fitness-related ads. You can learn more or adjust your preferences in our Privacy Policy settings.

By continuing to use Tricia, you agree to receive advertising content within the app. If you prefer an ad-free experience, we currently [do not offer a paid ad-free version] (if we introduce one in the future, we’ll let you know).


4. AI Content Disclaimer

One of Tricia’s unique features is the ability to chat with AI-generated agents and receive AI-generated content (such as journal prompts, replies, or summaries). While we aim to make these AI interactions helpful and enjoyable, it’s important to understand that AI content comes with significant limitations and is not a substitute for human judgment or professional advice:

Not Fact or Truth: AI-generated responses in Tricia are produced by machine learning algorithms. They may sometimes sound very realistic or confident, but they are not guaranteed to be factual, accurate, or up-to-date. The AI does not actually know truth from fiction – it generates content based on patterns in data. You should not treat AI-generated content as proven truth or authoritative guidance. Always double-check important information from reliable sources.

No Professional Advice: Any suggestions or information provided by the AI (or by Tricia in general) are for general informational and entertainment purposes. For example, if an AI agent gives you health-related journaling tips or life advice, that is not medical, legal, or professional advice. Always seek a qualified professional’s advice for important personal, medical, legal, or financial decisions. Never ignore professional advice or delay seeking it because of something you read from the AI.

Potential Biases or Offenses: The AI system strives to follow our guidelines, but it might occasionally generate biased, incorrect, or inappropriate content. We do not endorse or take responsibility for things the AI may say. If an AI agent’s response seems wrong or offends you, you can ignore it, delete it, or report it. We are continuously working to improve the AI’s safety and accuracy, but mistakes will happen.

User Discretion: You are solely responsible for how you interpret and use the AI-generated content. Tricia is not responsible for any actions you take (or fail to take) based on AI outputs. This includes any decisions that might harm you or others, or any loss or damage you experience, because you relied on something the AI said. Use your best judgment and take AI outputs with a grain of salt.

AI Identification: We will try to clearly indicate when content is AI-generated (for instance, AI agent messages are shown as such within the app). If you ever feel an AI agent’s response is confusing or you’re unsure if it’s AI or human, you can assume it’s AI-generated in this app.

In short, please use Tricia’s AI features responsibly and at your own risk. They are here to inspire and assist your journaling, but they are not infallible and they are not human. We appreciate your understanding of this cutting-edge (but imperfect) technology.

5. No Warranties (Service Provided “As-Is”)

Tricia is provided to you “as is” and “as available.” While we hope you enjoy using the app, there are some things we need to disclaim to manage expectations:

Service Quality: We make no promises that Tricia will always work perfectly. We do not guarantee that the app will be free of errors, bugs, or uninterrupted downtime. For example, there may be times when the service is unavailable for maintenance or technical issues.

Content Accuracy: We do not warrant that any content (whether from other users, the AI agents, or Tricia’s own information) is accurate, complete, or reliable. Use the information at your own risk, and understand it might contain errors.

No Implied Warranties: To the fullest extent allowed by law, we disclaim all warranties and conditions of any kind, whether express or implied. This includes implied warranties of merchantability, fitness for a particular purpose, and non-infringement. In plain language, we’re not making any official guarantee that the app will meet your needs or expectations, other than our commitment to provide the service under these Terms.

User Devices and Connections: Tricia isn’t responsible for any damage to your device or loss of data that may result from using the app. You are responsible for using reliable devices and internet connections, and for backing up your data as needed.

Some jurisdictions do not allow certain warranty disclaimers, so some of the above might not apply to you. In such cases, Tricia will only have the responsibilities and warranties mandated by law.

6. Limitation of Liability

To the maximum extent permitted by law, Tricia and its parent company, affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or in connection with your use of (or inability to use) our app and services. This sounds very legal, so here’s what it means in simpler terms:

Types of Damages Disclaimed: We are not responsible for losses or damages that are not directly caused by our wrongdoing. This includes things like lost profits or revenues, loss of data, personal injury, emotional distress, or any indirect, consequential losses that might result from using Tricia.

Use at Your Own Risk: Tricia is not liable for any harm or damage resulting from:AI Content or Advice: actions you take (or don’t take) based on AI-generated content or advice you got through the app.User Interactions: anything arising from interactions with other users, or from user-generated content (for example, if another user’s post offends or harms you, or if you meet someone through the app and something goes wrong). While we provide tools to report and moderate content, we aren’t responsible for the actions of users.Third-Party Ads or Links: your interactions with third-party advertisements or links found on Tricia. If an ad or link in our app leads you to another service or causes an issue, the third party is responsible, not Tricia.Data Loss: the loss or unauthorized access of your content or data, unless we are legally required to take responsibility. We encourage you to keep backups of any important journal entries.

Cap on Liability: If for some reason we are found liable, our total liability to you shall not exceed the amount you have paid us in the last six (6) months (and most users use the app for free, so that would be $0) or the minimum amount permissible under law. In some jurisdictions, you cannot limit liability this way, so this clause may not apply to you in its entirety.

No Class Actions: You and Tricia agree that any claims or disputes will be resolved only on an individual basis, and not as part of any class or representative action. This means you will not bring a claim against Tricia as a plaintiff or class member in a class, collective, or representative action (e.g., a private attorney general action) for any losses or damages.

Remember, we are offering a free service to you with the best intentions, but we need to protect ourselves from certain legal risks. If you are unhappy with the app or suffer any harm, your main remedy is to stop using Tricia. We appreciate your understanding on these limits.



7. Dispute Resolution and Governing Law

We truly hope we never have a dispute with our users. If you have an issue or complaint, we encourage you to reach out to our support team first so we can try to resolve it informally. However, if it comes to a legal dispute, the following terms apply:

a. Governing Law: These Terms and any dispute that arises between you and Tricia will be governed by the laws of the State of California, USA, excluding its conflict-of-law principles. If you use the app from outside the United States, other laws may apply to certain claims (for example, consumer protection laws of your country), but in all cases U.S. and California law will govern the interpretation of these Terms and any legal action between you and us.

b. Agreement to Arbitrate: You and Tricia agree that any disputes, claims, or controversies arising out of or relating to these Terms or your use of the app will be settled by binding arbitration on an individual basis. Arbitration is a process where disputes are decided by a neutral arbitrator instead of a judge or jury in court. In arbitration, there is no judge or jury, and court review of an arbitration award is limited. By agreeing to arbitration, we both waive our right to a trial in court and to participate in class actions, as noted above.Arbitration Procedure: The arbitration will be administered by a reputable arbitration organization (for example, the American Arbitration Association (AAA)) under that organization’s Consumer Arbitration Rules. The arbitrator will apply California law (as stated above) and can award the same damages and relief as a court (including attorney’s fees if allowed by law). The arbitration can be conducted in person in San Diego, California, or, for convenience, by video conference or telephone, or based on written submissions, depending on the circumstances and the rules of the arbitration forum.Exceptions: Either you or Tricia may choose to take disputes to small claims court if the dispute qualifies for small claims (small, individual disputes typically under a certain dollar amount). Also, any disputes about intellectual property rights or certain requests for injunctive relief (meaning urgent requests to stop misuse of the service, for example) may go to court instead of arbitration.Opt-Out Right: We respect that arbitration isn’t for everyone. You have the right to opt out of this arbitration agreement within 30 days of first accepting these Terms by sending us written notice (for example, by email to our support address) clearly stating that you wish to opt out of arbitration. If you opt out, disputes will instead be resolved in court as explained below.Arbitration Finality: The arbitrator’s decision will be final and binding, and judgment on the award may be entered in any court that has jurisdiction.

c. Venue and Jurisdiction: If for some reason a dispute is found not subject to arbitration (either because you opted out or a court says this arbitration clause is not enforceable), then you and Tricia agree that any such non-arbitrable lawsuit will be exclusively brought in the state or federal courts located in San Diego County, California, unless otherwise required by law. Both you and Tricia consent to the personal jurisdiction of those courts. This means if we end up in court, we’ll do it in California (absent contrary laws that apply to you).

d. Time Limits: To the extent permitted by law, any dispute or claim you might have against Tricia must be filed within one (1) year from when it arose. If it isn’t filed in time, it’s permanently barred. (For example, if you had an issue on Jan 1, 2025, you’d need to initiate arbitration or file a claim by Jan 1, 2026.)

We know this section is heavy, but we want to be transparent about how disputes are handled. In summary: by using Tricia, you and we agree to try to resolve any disputes amicably first; if that fails, we’ll use arbitration (with a few exceptions) or small claims court instead of big court lawsuits; and if we do go to court, it will be in California under California law.

8. Changes to These Terms

Tricia may update or modify these Terms from time to time. We do this to adapt to new features, legal requirements, or for other valid reasons. Here’s how that works:

Notice of Changes: If we make material changes (significant changes that affect your rights or obligations), we will notify you in advance by appropriate means. For example, we might send you an email to the address associated with your account or show a prominent notice within the app. Minor updates (like clarifications or grammatical fixes) might not be separately notified, so we encourage you to review the Terms periodically.

Acceptance of Changes: Updated Terms will have a new “Last Updated” date at the top. The changes will become effective on the date specified in the notice or when posted. By continuing to use Tricia after the new Terms take effect, you indicate your acceptance of the updated Terms. If you do not agree to a change, you should stop using the app before the updated Terms take effect and, if needed, delete your account.

Reviewing Changes: We understand Terms can be long, so when we do update them, we’ll do our best to provide a summary of what’s different. Nonetheless, the full Terms (this document) is what is legally binding. If you have questions about any change, feel free to reach out to us for clarification.


9. Other Important Things

a. Account Security: If your app requires an account or login, you are responsible for keeping your login credentials confidential. Don’t share your password. If you believe someone has gained unauthorized access to your account, notify us immediately. We aren’t liable for any loss or damage from your failure to protect your account.

b. Eligibility: Tricia is intended for users who are 18 years or older. If you are under 18, you may not use the app. If you are between 13 and the age of majority in your region, you should use Tricia under a parent or guardian’s supervision and with their consent. By using Tricia, you affirm that you are old enough to use it legally.

c. Suspension and Termination: You’re free to stop using Tricia at any time. Likewise, we reserve the right to suspend or terminate your access if we believe you have violated these Terms or you pose a risk to our community or service. If that happens, we’ll try to notify you (unless we are legally prevented or it’s an emergency situation). Even after your account is terminated, these Terms will remain in effect in terms of ongoing licenses you granted, our rights, any disclaimers, and our limitation of liability.

d. Severability: If any part of these Terms is found to be unenforceable or invalid by a court or arbitrator, the rest of the Terms will still apply and remain in effect. We would revise the offending part to make it enforceable, if possible, while keeping the original intent.

e. No Waiver: If we don’t immediately act on a violation of these Terms, it doesn’t mean we’re giving up any rights. For example, if you violate the Terms and we don’t take action right away, we still have the right to do so later or for a future violation, or someone else’s violation.

f. Entire Agreement: These Terms (and any referenced policies like the Privacy Policy and Community Guidelines) make up the entire agreement between you and Tricia regarding your use of the app. They replace any earlier agreements or understandings between you and us on the subject.
